Proving your case is critical, as plaintiffs (the people or parties who file the claims) have the burden of proof in personal injury cases.
To have a case, you must first prove that you were injured. You will also likely need to prove that the defendant owed you a duty of care, meaning they had a legal obligation to take certain actions and/or avoid certain actions to prevent foreseeable injury, and that the defendant failed to uphold this duty of care, most often by acting negligently or wrongfully. Lastly, you will likely need to demonstrate how the defendant’s conduct was the proximate cause of your injury and resulting damages.
